New laws relating to AI are being created around the world, and a new EU AI Act (Regulation (EU) 2024/1689) closely regulates systems that present significant or unacceptable risks to fundamental human rights. This risk and measurement-based approach to human rights is novel and raises questions about how rights and impacts can be monitored and quantified, the potential interaction with new ESG diligence and reporting frameworks and existing legislative rights of redress, and how private and public sector actors should arrive at a fair assessment of human rights risks and impacts in the context of powerful and fast-moving AI technology.
